We store your data in Switzerland on the servers of Infomaniak AG, a well-known Swiss-based service and hosting provider with their headquarters in  Switzerland. You can access more information about how Infomaniak handles your data on this page.

5. WITH WHOM DO WE SHARE YOUR INFORMATION AND WHY

Disclosure with third parties

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside Switzerland and choose to provide information to us, please note that we transfer the data, including Personal Data, to Switzerland and process it there.

datalex llc will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy notice and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Legal Requirements

datalex llc may disclose or share your Personal Data in the good faith belief that such action is necessary to:

  • protect and defend the rights or property of datalex llc
  • prevent or investigate possible wrongdoing in connection with the Service
  • protect the personal safety of users of the Service or the public
  • protect against legal liability

However, where you instruct one of our partner lawyers for a particular matter, attorney-client privilege may apply and prohibit any disclosure of your personal data without prior consent.

6. HOW LONG DO WE KEEP YOUR DATA

  • ACCESS RIGHTS. If you wish to access, correct, update or request deletion of your personal information, you can do so at any time either by connecting to the online portal with your account details, or by sending an email to privacy@datalex.ch;
  • OBJECT. You can object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information, where applicable. You can exercise these rights either by connecting to the online portal with your account details and use the available options, or by sending an email to privacy@datalex.ch;
  • OPT-OUT. You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.  To opt-out of other forms of marketing (such as postal marketing or telemarketing), then please email privacy@datalex.ch;
  • CONSENT WITHDRAWAL. Similarly, if, and to the extent, we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent; and

We ensure to have appropriate data processing agreements with our business partners that operate on our behalf as data processors so that we are informed of any occurrence of a breach of security, of resilience, of availability or of confidentiality.

From time to time, we may receive data from third parties that relate to you.

What automated decision making and/or profiling we do with user data

We do not perform any such tasks with our platform.

Industry regulatory disclosure requirements

Occasionally, we offer services, such as external data protection officer (DPO) services, where legal requirements may impose us to disclose information about you. Disclosure of data and personal data may become mandatory in particular in the event of a cybersecurity incident, a data breach, or when we object to a data subject request or to fulfill legal and regulatory requirements.
