pas infliger d&#8217;amende en cas de violation des lois sur la protection des donn\u00e9es.<\/p>\n<p>Contrairement \u00e0 l&#8217;Europe qui conna\u00eet un r\u00e9gime de sanctions par des amendes administratives, la Suisse ne pr\u00e9voit que des sanctions par la voie d&#8217;une proc\u00e9dure p\u00e9nale, soit pour violation du secret m\u00e9dical (art. 321 CP), soit pour violation du devoir de discr\u00e9tion (art. 35 LPD). Avec la r\u00e9vision de la loi f\u00e9d\u00e9rale sur la protection des donn\u00e9es, de nouvelles dispositions avec des obligations plus strictes sont cr\u00e9\u00e9es. Cela rendra certaines violations en mati\u00e8re de protection des donn\u00e9es m\u00e9dicales p\u00e9nalement r\u00e9pr\u00e9hensibles, avec des amendes allant jusqu&#8217;\u00e0 CHF 250&#8217;000.-. Ces amendes ne pourront \u00eatre inflig\u00e9es que si ces violations sont intentionnelles.<\/p>\n<p>Pour les m\u00e9decins, une violation de la loi f\u00e9d\u00e9rale sur la protection des donn\u00e9es impliquera pratiquement toujours une violation du secret m\u00e9dical, lequel pr\u00e9voit une sanction plus s\u00e9v\u00e8re que sous la LPD.<\/p>\n<p><strong>Dol \u00e9ventuel<\/strong><\/p>\n<p>Lorsqu&#8217;un professionnel prend une d\u00e9cision sur le traitement des donn\u00e9es de sant\u00e9, conscient d&#8217;une prise de risque ou d&#8217;une vuln\u00e9rabilit\u00e9 potentielle d&#8217;un moyen de communication ou d&#8217;une technologie, s&#8217;il d\u00e9cide de prendre ce risque, cela constitue une intention au sens du Code P\u00e9nal (dol \u00e9ventuel) ce qui devient punissable.<\/p>\n<p><strong>Examples<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Exemple 1<\/span>: Un m\u00e9decin envoie une pi\u00e8ce jointe contenant des informations m\u00e9dicales \u00e0 un tiers sans le consentement du patient. Dans ce cas, le secret professionnel sera \u00e9galement viol\u00e9.<\/p>\n<p><span style=\"text-decoration: underline;\">Exemple 2<\/span>: Un patient demande d&#8217;acc\u00e9der \u00e0 son dossier m\u00e9dical. Le professionnel de sant\u00e9 lui fournit une partie de son dossier seulement ou transmet des renseignements inexacts. Dans ce cas, seul la LPD est viol\u00e9e (et non le secret professionnel).
